Thanks, Paul. Maybe the question for the EPDP team is whether there is a way to modify the Mutual Jurisdiction clause to make it clear (and effective at law) that an IGO Complainant is not waiving its immunities, but nevertheless identifies a jurisdiction in which that question must be answered by a court; and that must then be the jurisdiction where the registrant must file?

FYI Brian's phone keeps dropping in and out, so he's likely not able to follow the discussion closely.

Oh that is helpful, David. Thank you - I understand; it actually does sounds like it could be more compatible with what I was trying to suggest. The point I wanted to make is to not try to deal with the question of submitting to jurisdiction up front, but see if there is a way to limit or define where the case is heard.
OECD -Alexandra Excoffier

Same thing, right?
Mary Wong - ICANN Org

The language is perhaps more contradictory than it is confusing.
OECD -Alexandra Excoffier
01:21:55
submit is in itself a prejudice to immunities
Justine Chew (Member - ALAC)
01:22:13
@Jay, I think "will submit" trumps "without prejudice to"
